Compliance Investigator

The Compliance Investigator partners with the Senior Compliance Investigator and Legal Counsel to facilitate the Company’s response to formal charges of employment discrimination, retaliation, and other employment violations received from state and federal agencies. This position is also responsible for staying informed on upcoming employment laws, researching all details of these laws, and updating reference materials accordingly. The position will also be expected to work with the appropriate teams to implement changes and communicating changes to the field. The Investigator assists with wage and hour investigations or wage and hour audits.

ESSENTIAL JOB FUNCTIONS

Investigate and respond to demand letters and formal charges of discrimination filed through the Equal Employment Opportunity Commission or applicable state agency. Engage with leadership and field HR personnel to provide guidance and support on employment risks identified throughout the investigative process.

Investigate and respond to administrative subpoenas or audits as it relates to any state specific ordinances.

Coordinate with counsel to prepare for and present the Company's position in mediation or conciliation related to formal charges of discrimination and/or retaliation.

Represent the Company in depositions and/or employment litigation.

Analyze large quantities of to make the appropriate employment recommendations.

Identify potential areas of employment compliance vulnerability and propose and assist in implementing solutions to remediate identified risks.

Research and implement any current or upcoming federal, state, local, and international employment laws regarding drug testing, anti-harassment, non-discrimination, etc.; includes research for Puerto Rico, Mexico, and Canada.

Review articles, ordinances, FAQs, attending webinars, case law, XpertHR, state employment sites, and any other available information.

Consult with counsel and coordinate the implementation of new ordinance or laws with applicable teams.

Prepare communication and documentation for the applicable field team to share at the time of implementation of a new law or ordinance.

Maintain the state pages and policy manual located on the Company’s intranet and coordinate applicable updates to the Company’s policy manual and employment documents.

Respond to requests for timecard audits and conduct random audits of time records and report to applicable field leadership, as needed.

Consult with counsel to investigate and respond to internal and external wage and hour claims or audits, as needed.

Compile, prepare, and maintain relevant documents in the Company’s case management system related to wage and hour claims or audits and formal charges of discrimination.

Maintain a Master Tracking List of Employment Laws and a working knowledge of relevant employment laws and company policies.

All other duties as assigned.

SKILLS/EDUCATION/EXPERIENCE

Required:

High school diploma or equivalent (GED)

Experience conducting sensitive and confidential investigations with emphasis on interview and investigation techniques

Strong analytical and critical thinking skills with the ability to exercise discretion and maintain a high level of confidentiality

Demonstrated organizational, planning, and time management skills

Strong written, verbal, and interpersonal communication skills

Demonstrated knowledge of and ability to interpret federal, state, and local equal opportunity, civil rights, and non-discrimination laws and regulations that apply to employment settings

Ability to work well under pressure and multitask to meet multiple and simultaneous deadlines

Strong computer skills (MS Word, MS Excel, Microsoft Outlook and HRIS system)

Ability to work with high motivation and limited supervision

Maintain composure in stressful situations and consistently exemplify excellent customer service

Desired:

Bachelor’s Degree in Human Resources (equivalent work experience of 2 years considered in lieu of degree)

Previous team member relations and investigative experience
